An occupancy agreement is needed to be signed when a person moves to a new home. The main purpose of using this agreement is to set some terms and conditions between the two parties. The housing officer will tell all the responsibilities and rights of the tenant through the occupancy agreement.
When you pay for the house, then you are given some rights. You have the right to live peacefully in that house some other rights are also granted depending upon the type of agreement that is signed. There are main types of agreements in ACT which are tenancies and occupies. Using Occupancy Agreement Templates
There are some locations where the occupancy agreement cannot be imposed such as retirement villages, federally funded supported accommodations, etc. The person who has signed the occupancy agreement and who lives in the house is called the occupant and the person who owns the house where the occupant lives is called the grantor. If we compare the occupancy agreement with the tenancy agreement, then in the tenancy agreement, the person who lives in the house by paying the rent is called the tenant, and the person who owns the house is called the landlord.
There are some rights to occupy houses which may or not be exclusive. This means that in some cases, the occupant is given the right to lock the premises and to not allow the grantor to enter the premises and in some cases, this right is not given to the occupant. So, the occupancy agreement may or not give the rights to use the facilities such as furniture or other goods to the occupant.
Importance of Occupancy Agreement Templates
The agreement can be completely available in written form or in oral form. The agreement can also exist in partially written and partially oral form. If the agreement is oral, then the type of agreement and the terms and conditions should be set and decided in the conversation. However, it is useful to prepare the occupancy agreement in written form. According to the rule, if the agreement lasts for more than six weeks, then it is necessary for the occupants to bring the occupancy agreement in written form.
There are also some house rules which are added to the occupancy agreement. the rules will tell the responsibilities to the occupant and they will also tell the consequences of violating the rules. The occupant should also negotiate with the grantor for the house rules. Only meaningful and reasonable rules should be imposed.
The grantor cannot change any terms and conditions once the agreement has been signed. He will have to wait till the agreement ends. Any change in terms and conditions can be brought only with the consent of both parties who are involved in the agreement. Once the terms and conditions have been decided, both parties are bound to follow them
