Types of Maintenance Agreements:
When discussing Maintenance Agreements, most of these contracts take the form of a Memorandum of Understanding or MOU. It is generally a signed document by the client alongside the service provider which highlights the fundamental agreement terms and conditions with a mutual understanding of rights and obligations for both parties. Still, another kind is called Master Agreement (MA), which stands for all service particulars from the client’s perspective including service delivery standards or payment timelines on one side and rights from the service provider’s end. Another type is known as the Service Level Agreement (SLA), which is an agreement that has details and a brief explanation of each service expected by the client in terms of quality.
Key Elements of a Maintenance Agreement:
The first and most important element of the maintenance agreement is to mention the names of both parties that are involved in the partnership. Whether it’s an individual client or a corporation, the name of the receiver will be mentioned in the agreement. In the same manner, whether the service provider is also an individual or a company, their name will be mentioned in the agreement. Along with both of their names, the name of the insurer will also be included in the agreement.
The agreement will also include details about when services will be provided to customers and the time period within which they are expected to end. If customers wish them on specific days like one month or three months from now it should be stated in the contract. Consequently, any agreement prepared targeting three years or just below one year must specify intervals at which it will be serviced; say once per month, bi-monthly, or quarterly.

The payment for each type of maintenance service should also be included in the agreement. It is important to mention the specific charges for each type of service and the rates on which both parties agreed. In the same manner, the payment schedule is also important to mention in the agreement along with the method of payment i.e. cash, check, or bank draft.
Handling misunderstandings or situations where the agreement is violated or breached by either party is also a very important part of the Maintenance Agreement. It is possible that even if they don’t have any knowledge, either party will violate a clause of the agreement and when this information is included in the original contract, the other party will have a clear vision about their choices and legal steps they can take against the breach.
